‘Keluhuran Perlembagaan’ (The Supremacy of the Constitution) is the third principle of the Rukun Negara (National Principles). The Supremacy of the Constituion is above the highness of the King, parliament, cabinet and the court.

Once the National Chairman of DAP, Karpal Singh said Pakatan Rakyat would take legal action against the Sultan of Perak, Sultan Azlan Shah and the BN for proceeding with the swearing-in, we already predicted that UMNO and BN will take advantage over this. That is, by claiming that Pakatan Rakyat ‘insulting’ the King and the Malay people.

The jurisdictions of the King are according to the Constitution. As claimed by the leading lawyer, the Sultan had acted beyond his powers in dismissing the Pakatan state government which was ultra vires to Article 16 of the Perak Constitution. The Article states that if the Mentri Besar ceases to command the confidence of the majority of the members of the legislative assembly he shall tender the resignation of the executive council. This is unless on the MB’s request, His Royal Highness dissolves the legislative assembly.
